'TALAQ', do you know uttering this word three times can ruin a woman's life in some Muslim communities. TALAQ is being an illegal method to many Men to get rid of their wives and to marry the other. From last two years, TALAQ Divorce is crushing between the Muslim Minority Associations and Courts. Finally, after long suspense Supreme Court has made some relief statements for Muslim Women to get protected from this unlawful traditional Divorce system.
From the past two years, Five women filed a case in Supreme Court stating that they got divorced in an unconstitutional way and their lives got ruined by this kind of Divorce system. The petitioners who are fighting against TRIPLE TALAQ system are Shayara Bano, Afreen Rehman, Gulshan Parveen, Ishrat Jahan, Atiya Shabri. These TALAQ victim women are fighting to regulate Marriage and Divorce system in Muslims under the law.
This bench has consulted and studied religional laws of 19 Muslim countries like Pakistan, Egypt, Turkey, South Asia and cited that these countries had abolished this TALAQ system in their respective countries. This bench has also heard many versions of Muslim communities for six days before declaration of its Judgement. Finally, they stated "Nowhere in Islam stated TALAQ is Religious", It was not an Islamic method as per QURAN.
What is Triple TALAQ :
Some Muslim communities follow anti-law Divorce system which allows the men in that community to give Divorce to his wife by TALAQ procedure. In this kind of system, the man can Divorce his wife by uttering the word TALAQ three times like "TALAQ TALAQ TALAQ", in means of the way he can. He can say it orally or through text message. Once the wife got TALAQ from her husband she is no more his wife and she had been getting divorced. Some Muslim Associations are supporting this kind of Divorce acts and some Muslim communities are against it and fighting for the Women rights.

After taking up these TALAQ cases Supreme Court has set a multi-religion bench having 5 judges from 5 religions.This bench consists of Chief Justice J H Khehar (a Sikh), Kurian Joseph (a Christian), RF Nariman (a Parsi), UU Lilith (a Hindu), Abdul Nazeer (a Muslim). TRIPLE TALAQ JUDGEMENT :
On 2nd December of 2017, Supreme Court has declared that TRIPLE TALAQ is an unconstitutional practice of Divorce system and it will be considered as illegal. To protect and Safeguard Women rights it will be draft under legislation and the Person who tries to get instant Divorce TRIPLE TALAQ in any format (orally or text format )will be sentenced to jail for 3 years.
